O, North Hollywood, California 91605-7644. We also conducted an inspection on April 6, 2021 to April 16, 2021, and on June 28, 2022 to July 14, 2022. These inspections were conducted to determine your compliance with the requirements of section 805 of the Federal Food, Drug, and Cosmetic Act (FD&amp;C Act) (21 U.S.C. 384a) and the implementing FSVP regulation in 21 CFR part 1 subpart L.\u003C\u002Fp>\n\n\u003Cp>The FSVP regulation requires that importers perform certain risk-based activities to verify that human and\u002For animal food they import into the United States have been produced in a manner that meets applicable U.S. food safety standards. You did not develop, maintain, and follow an FSVP as required by section 805 of the FD&amp;C Act and 21 CFR 1.502(a). Specifically, your firm did not develop an FSVP for any of the foods that you import, including:\u003C\u002Fp>\n\n\u003Cul>\n\t\u003Cli>Adjika (Red Pepper Tomato Dip), Hot Eggplant Spread (Caviar), and Imam Bayaldi (Eggplant Spread) imported from \u003Cstrong>(b)(4)\u003C\u002Fstrong>;\u003C\u002Fli>\n\t\u003Cli>Natakhtari (Pear) Soft Drink imported from \u003Cstrong>(b)(4)\u003C\u002Fstrong>.\u003C\u002Fli>\n\u003C\u002Ful>\n\n\u003Cp>During our inspection, you provided the investigator with two documents you obtained from your foreign suppliers: a one-page letter from your foreign supplier \u003Cstrong>(b)(4)\u003C\u002Fstrong> with information regarding “prevention and control of biological, chemical and physical hazards during production of acidified canned food products,” with no specific product identified, and a letter from your foreign supplier \u003Cstrong>(b)(4)\u003C\u002Fstrong> listing their certificates from organizations \u003Cstrong>(b)(4)\u003C\u002Fstrong>&nbsp;for the production of beer and carbonated soft drinks. Although these documents could be relevant to development of an FSVP, you did not provide a record of your review of the documents or explain how they would apply to your FSVP program. Thus, these documents do not constitute an FSVP as required by section 805 of the FD&amp;C Act and 21 CFR 1.502(a).\u003C\u002Fp>\n\n\u003Cp>2. For thermally processed low-acid foods packaged in hermetically sealed containers (low-acid canned foods), with respect to those microbiological hazards that are controlled by following 21 CFR part 113, you must verify and document that they were produced in accordance with 21 CFR part 113, as required by 21 CFR 1.502(b)(1).
